TERMS & CONDITIONS
1. General Information
These General Terms and Conditions (GTC) apply to all contracts concluded between PulseRun DE (hereinafter referred to as "Organizer") and the participant (hereinafter referred to as "Participant") regarding participation in sports events, marathons, and running competitions organized by PulseRun DE. By registering for an event, the Participant explicitly accepts these Terms and Conditions.
The Organizer reserves the right to amend these terms at any time. The version valid at the time of registration shall apply. These events are conducted in accordance with the regulations of the relevant national athletics associations where applicable.
2. Registration and Conclusion of Contract
Registration for events must be made exclusively via the online form provided on the official website. Registration by telephone, email, or fax is not accepted unless explicitly stated otherwise.
By clicking the "Register" or "Submit" button, the Participant makes a binding offer to conclude a contract. The contract is concluded upon confirmation of registration by the Organizer, typically sent via email alongside the payment confirmation.
The Participant confirms that all personal data provided during registration is correct. The Organizer assumes no liability for issues arising from incorrect data entry (e.g., undeliverable race bibs or incorrect age group classification).
3. Eligibility and Health Requirements
Participation is open to anyone who has reached the age specified in the event description (usually 18 years for full marathons). Minors may only participate in specific distances with the written consent of a legal guardian.
Health Declaration: By collecting the start number, the Participant declares that there are no health concerns regarding their participation. It is strongly recommended that every Participant undergo a medical examination before the event. The Organizer does not request medical certificates unless required by specific event regulations, but relies on the Participant's self-assessment.
The Organizer reserves the right to disqualify any Participant who exhibits clear signs of physical exhaustion or health risks during the event to prevent harm.
4. Payment and Cancellation
The participation fee is due immediately upon registration. Payment methods are specified in the registration process. If payment is not received within the stipulated time, the Organizer reserves the right to cancel the registration.
- Cancellation by Participant: Participation fees are generally non-refundable. However, the Participant may transfer their entry to another person up to 14 days before the event for a processing fee of €15.
- Cancellation by Organizer: If the event is cancelled due to force majeure (e.g., extreme weather, official orders, pandemics), the Organizer is not liable for damages. In such cases, the Organizer will strive to offer a partial refund or a voucher for a future event, though this is not guaranteed.
5. Liability and Disclaimer
Participation is at the Participant's own risk. The Organizer is liable without limitation for damages resulting from injury to life, limb, or health caused by a negligent or intentional breach of duty by the Organizer or its legal representatives.
For other damages, the Organizer is only liable in cases of intent or gross negligence. Liability for slight negligence is excluded, provided that no essential contractual obligations (cardinal obligations) are violated. In the event of a breach of essential contractual obligations, liability is limited to the foreseeable, typical damage.
The Organizer assumes no liability for lost valuables, clothing, or equipment. Participants are advised not to bring expensive items to the event area.
6. Data Protection and Media Rights
The personal data provided by the Participant will be stored and processed for the purpose of organizing and conducting the event. This includes the publication of name, birth year, club, and race results on the event website.
Photography and Video: The Participant agrees that photos, videos, and interviews made in connection with the event may be used by the Organizer for broadcasting, telecasting, advertising, and commercial purposes without any remuneration. This includes usage on social media, print marketing, and the official website.
7. Safety Regulations and Conduct
Participants must follow the instructions of the event staff, police, and medical personnel at all times. Leaving the marked course is prohibited and will lead to immediate disqualification.
The use of technical aids that could endanger others (e.g., bicycles, inline skates, poles) is prohibited unless explicitly allowed for a specific race category. The wearing of headphones is discouraged for safety reasons but is not strictly prohibited unless specified otherwise in the race briefing.
8. Final Provisions
These Terms and Conditions are subject to the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from this contract is Berlin, Germany, to the extent permitted by law.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
